If you do not agree to these terms, please do not use our service. 2. Service Description glowUP provides AI-powered photo transformation services that enhance your images while preserving your core facial features. Our service uses advanced machine learning, specifically Google's Nano Banana technology, to create studio-grade, professional results. 3. Artistic Character of AI Outputs You acknowledge that glowUP uses generative technology to provide high-quality, editorial-style portraits. The App generates artistic interpretations and simulations of professional photography rather than forensic replicas. Because every transformation is a unique creative collaboration between your photo and our AI, variations in lighting, texture, and fine facial details are an inherent part of the creative process and are not considered technical defects. 4. Eligibility & Geographic Restriction You must be at least 18 years of age to use this App. This App is intended for use solely by residents of the United States and Canada. Accessing the service from outside these regions is prohibited for legal and privacy compliance reasons. 5. User Responsibilities You agree to: • Only upload photos you have the legal right to use. • Be the person depicted in the photos to ensure likeness rights are respected. • Not use the service for illegal purposes, including the creation of deepfakes, non-consensual imagery, or sexually explicit content. • Comply with all applicable laws and regulations in your jurisdiction. 6. Ownership & AI Watermarking • User Content: You retain ownership of any original photos you upload. • AI Outputs: You own the resulting transformed portraits generated by the App. • Watermarking: Images processed by Nano Banana may include invisible watermarking (such as Google's SynthID) or metadata to identify content as AI-generated. You agree not to attempt to remove or circumvent these safety identifiers. 7. Payments & Credits Our service operates on a purchase-per-transformation basis. Credits or processing fees are non-refundable once purchased, as the AI transformation service is initiated and consumed immediately. All transactions are processed via the Apple App Store. 8. Limitation of Liability glowUP is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the service or for any results that do not meet your specific aesthetic expectations. 9. Changes to Terms We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through a notification within the App. 10. Refund Policy Because glowUP provides immediate digital content and AI processing at the time of purchase, all sales are final. We do not offer refunds, credits, or exchanges for any in-app purchases. How to Request a Refund via Apple Since all payments are handled by Apple, glowUP does not have the technical ability to issue refunds directly.
